AGREEMENT FOR JOINT ACTIVITY

MTÜ Eesti Naabrivalve, (Nonprofitable Association Estonian Neighbourhood Watch) represented by Chairman of the Board
(hereafter referred to as A)
Local Municipality, represented by ................................., which acts upon Statute
(hereafter referred to as B);
Police, represented by ……………………………..
(hereafter referred to as C) and
Chief of  ....................... Neighbourhood Watch Sector ..........................,
(hereafter referred to as D)
which are hereafter referred to in this Agreement as Party or together Parties,
have concluded present Agreement in following:

1. Documents of Agreement

a.    Documents of Agreement consist of present Agreement, Supplements and Amendments to Agreement, which are agreed upon after concluding present Agreement.
b.    Lisa 1 – Description of  …………….. Neighbourhood Watch Sector.
c.    Lisa 2 – List of participants in ……………… Neighbourhood Watch Sector neighbourhood watch.

2. Goals of Agreement

2.1. Goals of present Agreement are :
1)    Prevention of crime in ………………… Neighbourhood Watch Sector;
2)    Organizing of neighbourhood watch in the stated area;
3)    Co-operation between Parties in achieving goals of Agreement.

3. Rights and Obligations of Parties

3.1. MTÜ Eesti Naabrivalve (NPA Estonian Neighbourhood Watch) :
1)    Gives participants all kinds of information about organizing of neighbourhood watch;
2)    Distributes learning materials on neighbourhood watch among members of sector;
3)    In co-operation with chief of sector and Local Municipality helps to organize training days and gatherings;
4)    Organizes training in neighbourhood watch for the chief of sector;
5)    If possible, supports activity of sector financially,

3.2. Local Municipality :
1)    Helps organizing training days and gatherings for active group of sector;
2)    If possible, supports publishing and distribution of information carriers (brochures, booklets etc);
3)    Reflects what concerns neighbourhood watch in local press organ ``……………..``;
4)    Co-operates with chief of sector in resolving current issues;
5)    If possible, finances neighbourhood watch in any other way;


3.3.  Police :
1)    Distributes through chief of sector information necessary for neighbourhood watch;
2)    Reacts to observations received from neighbourhood watch;
3)    Organizes corresponding training for police co-ordinator persons;
4)    On sector meetings explains and teaches participants in neighbourhood watch according behaviour;
5)    If possible convocates into the project students of educational facilities of public order protection and assistant policemen;

3.4.  Chief of …………………... Neighbourhood Watch Sector:
1)    Organizes general co-operation between sector, Estonian Neighbourhood Watch, Local Municipality and police;
2)    In co-operation with Estonian Neighbourhood Watch, police and Local Municipality carries out meetings of sector and trainings of participants in neighbourhood watch;
3)    In co-operation with Estonian Neighbourhood Watch and Local Municipality organizes acquiring of badges for participants in neighbourhood watch;
4)    In co-operation with police fixates order of notifying of observations;
5)    Keeps record on participants of neighbourhood watch;

4. Term, changing and termination of Agreement

4.1. Present Agreement comes into force from the moment of concluding and is concluded sine die.

4.2. Parties have the right to change Agreement only if agreed with Parties, notifying other Parties of it at least 1 (one) month beforehand.

4.3. Parties have the right to terminate present Agreement at any time notifying other Parties of it at least 1 (one) moth beforehand.

5. Messages between Parties

5.1. Messages between Parties connected with present Agreement must be in writing, except for cases, when such messages are only of informative character, which does not entail legal consequences to other Parties.

5.2. Message is regarded delivered if:
1) message was handed over and was signed for;
2) message was sent by Post institution as registered mail on addresses shown by Parties and 5 (five) calendar days have passed from the posting day;
3) message was forwarded to another Party by fax.  

5.3. Informational message may be forwarded by phone or alike.

6. Force Majeure

6.1. Failing to perform obligations or to perform obligations accordingly upon present Agreement is not regarded as breach of Agreement, if it was caused by circumstances not foreseen by Parties while concluding Agreement, and could not possibly forecast their arrival (Force Majeure).
In present Agreement Force Majeure is considered:
  • Upraise, general strike, mass disorders in administrative unit of Parties’s location;
  • war;
  • Bill of Riigikogu or Government, which significantly hinders performing of present Agreement;
  • Other circumstances not stated in Agreement, which are accepted as Force Majeure by all Parties.
6.2. Party, whose action on performing obligations upon Agreement is hindered by circumstances of Force Majeure, is obliged to notify of it immediately other Parties.

6.3. If the circumstances of Force Majeure last for more than 30 days, Parties will through negotiations decide possibilities of performing their obligations upon Agreement.

7. Other conditions

7.1. All disputes arising from present Agreement will be tried to resolve through negotiations. If negotiations will not bring results, the disputes will be resolved in order stipulated by legislation of Republic of Estonia.
7.2. Present Agreement annuls all previous oral and written agreements made by Parties on matters fixed in this Agreement.

7.3. None of Parties may forward rights and obligations upon present Agreement to third persons without written consent of other Parties.

7.4. All changes and amendments to present Agreement come into force after being signed by all Parties or on time assigned by Parties in writing.

7.5. Representatives of Parties in controlling of fulfilment of present Agreement are:

If a Party should change its Representative with another, it immediately notifies other Parties of it.

7.6. Present Agreement is drown up in Estonian in 4 (four) identical copies that possess equal legal force, of which every Party receives one copy.
